Sickels, Frei & Mims is proud to announce that a case handled by Steve Frei and Matt Perushek has been listed as a top verdict of 2014 by two publications. The case involved a brain-injured Plaintiff that ended with a $1.5 million verdict in favor of the Plaintiff.
The Washingtonian listed the verdict as the Number 5 largest verdict in our area. Virginia Lawyers Weekly listed the verdict as the Number 18 largest verdict in Virginia.
The Plaintiff was a Ph.D. research scientist that was rear-ended while on a road trip with his wife. Like many brain injured individuals, the Plaintiff gradually started experiencing neurological symptoms, such as confusion, issues with memory, and trouble concentrating. The Plaintiff was eventually diagnosed with post-concussive syndrome.
The Plaintiff’s symptoms continued to decline. He treated with a neurologist and speech pathologist to help him manage his symptoms. The Plaintiff was unable to work after the collision.
The defense attempted to argue that the Plaintiff had underlying depression (that was never diagnosed by any treating physician) that, coincidentally, manifested after the collision. In response, Steve and Matt worked with the Plaintiff’s neurologist to obtain a PET CT scan that showed objective evidence of brain damage.
Before trial, the defense offered $200,000 to settle the case. After only two hours of deliberating, the jury returned $1.5 million in favor of the Plaintiff.
